Western Texas College prohibits sex discrimination, sexual harassment, sexual assault, dating violence, domestic violence, stalking and retaliation. You can report a concern, ask questions or request support without starting a formal complaint.

Western Texas College does not discriminate on the basis of sex in the education program or activity that it operates. WTC is required by Title IX of the Education Amendments of 1972 and 34 C.F.R. Part 106 not to discriminate in this manner. This requirement extends to admission and employment.

Inquiries about the application of Title IX and 34 C.F.R. Part 106 to WTC may be referred to WTC’s Title IX Coordinator, the U.S. Department of Education’s Office for Civil Rights, or both.

Any person may report sex discrimination, including sexual harassment, whether or not that person experienced the conduct. Reports can be made in person, by mail, telephone, email or online, including outside regular business hours.

• The Title IX Coordinator will promptly contact the person affected.

• WTC will explain supportive measures and how to file a formal complaint.

• Supportive measures may be available with or without a formal complaint.

• WTC prohibits retaliation for reporting or participating in a process.

Report any concern about sex discrimination or sexual misconduct. WTC may address conduct under another College policy even when it does not meet the federal Title IX definition below.

This plain-language overview does not replace WTC’s complete, board-approved grievance procedures. Those procedures control and must state all timeframes, standards, hearing rules and appeal rights.

The Title IX Coordinator contacts the person affected, discusses available supportive measures and explains how to make a formal complaint.

A complainant may file a signed complaint requesting an investigation. In limited circumstances, the Title IX Coordinator may sign a complaint.

Known parties receive written notice of the allegations and information about the grievance process, rights and responsibilities.

A trained, impartial investigator gathers relevant evidence. Both parties receive an equal opportunity to identify witnesses and review directly related evidence.

For a postsecondary Title IX formal complaint, a trained decision-maker conducts a live hearing under the procedures in WTC’s adopted policy.

The decision-maker issues a written determination applying WTC’s stated evidence standard. The parties receive the determination simultaneously.

Both parties receive an equal opportunity to appeal on the grounds stated in WTC’s adopted grievance procedures.
