TEXAS PUBLIC INFORMATION ACT
The Texas Public Information Act gives the public a right to request access to government information. Requests must seek records or information already in existence; the Act does not require the College to create new substantive information, answer interrogatories, or perform legal research solely to respond to a request.
Important: A written communication seeking existing College records may constitute a public information request even if it does not use the words “Public Information Act.”
How to Access Western Texas College Public Information
Written requests should be submitted through one of the College’s published, designated methods. The College will publish its designated mailing address, email address, and any other approved submission method.
Electronic submission: use the request form below or the designated PIA email address.
U.S. mail: send to the College’s designated PIA mailing address.
Hand delivery: deliver to the location identified by the College for PIA requests.
What to Include
Your name and contact information.
A clear description of the records or information requested.
Relevant date ranges, departments, employees, subjects, or search terms, when known.
Whether you want to inspect the records, receive copies, or both.
Your preferred electronic file format, if applicable.
What Happens After You Submit
The Primary PIA Coordinator reviews the request, identifies applicable deadlines and likely Records Custodians, and routes the request for collection. Records Custodians identify and provide responsive records and document the search conducted.
Before records are produced, the College completes compliance and secondary quality-assurance review. Responsive public information is produced as promptly as possible under the circumstances.
Request for Clarification
WTC may ask a requester to clarify a public information request if it is unclear or to narrow the scope if the request involves a large amount of information. A requester must respond in writing within 61 calendar days after receiving a written request for clarification or additional information. If the requester does not respond within that time, the public information request will be considered withdrawn.
Charges for Requests
Some requests may involve charges authorized by Texas Attorney General cost rules. The College does not create its own fee schedule and will not charge more than permitted by law.
Cost thresholds
$40 or less: only allowable charges may be assessed.
More than $40: the College will provide a written, itemized estimate before completing work subject to the estimate.
More than $100: after providing the required estimate, the College may require an authorized deposit for anticipated costs.
If a requester modifies or narrows a request, the College may recalculate the estimated cost. If actual charges may exceed the estimate by 20% or more, an amended estimate may be required before additional work is performed.
Information That May Not Be Public
Some information maintained by the College may be confidential by law or subject to an exception to required disclosure. Depending on the information requested, the College may redact information, rely on an applicable previous determination, provide required third-party notice, or request a decision from the Office of the Attorney General.
Examples may include confidential student information, certain employee information, attorney-client communications, information made confidential by statute, or protected third-party proprietary information.
